Not All Dirt Is Worth the Dig: Why Civil Feasibility Should Come Before the Deal


In Houston's development market, the purchase price of land is only the beginning of the story.

A tract that looks like a great deal on paper can become significantly more expensive once a developer understands what it will actually take to make the property buildable.

Some of the largest costs are often below ground, tied to infrastructure, or hidden in the development requirements.


Issues That Can Significantly Affect a Project Budget


  • Floodplain and dirt fill. Raising portions of a site three to five feet can require massive quantities of imported fill, dramatically changing site-development costs.


  • Detention. Large detention basins can consume acreage that could otherwise generate revenue.


    Retaining-wall detention can reduce the pond footprint and recover usable land, but the added structural cost can be significant.


  • Utility extensions and capacity. A property may be advertised as having utilities available, but proximity to a water or sanitary sewer line does not necessarily mean adequate capacity exists.


    This is especially critical for high-density multifamily and mixed-use developments. Existing water and wastewater systems, lift stations, and treatment facilities may not have the capacity to accommodate the proposed development without significant public infrastructure extensions or upgrades.


  • Pipeline and easement conflicts. Pipeline crossings and existing utility easements can affect site layout, roadway connections, utility routes, and developable acreage, sometimes requiring expensive crossings or redesign.


  • Impact fees. Rising water, wastewater, roadway, and other applicable impact fees can represent a substantial upfront development cost.


  • Entitlements and rezoning. A property's value may be based on its intended use, but obtaining the necessary zoning, entitlements, variances, or approvals can add both cost and time before construction begins.


  • Longer review timelines. Delayed engineering and agency review times can translate into additional land carry, financing, and scheduling costs.


Another issue we frequently encounter at JRH Engineering is assumed infrastructure. Developers sometimes come to us after being told that a tract has utility capacity or that detention has already been provided. Sometimes it has. Sometimes, after further investigation, we find that the capacity isn't available or hasn't actually been allocated to that property.


That can be an expensive discovery after the land has already been purchased.


Case Study: "Utilities Available" Doesn't Always Mean Utilities Are at the Site


The Project


JRH Engineering provided civil engineering support for a 100+ acre development in Texas, sold to the developer with the understanding that water and sanitary sewer utilities were available to serve the site.


The Challenges


  • While system capacity did exist, the developer later learned that the infrastructure still had to be physically extended approximately 12,000 feet for water and 5,500 feet for sanitary sewer to reach the development.


  • The sanitary sewer extension had to cross an existing pipeline.


  • The initial pipeline clearance requirement was five feet, which would have affected the gravity sewer elevations enough to potentially require a costly wastewater lift station.


The Objectives


  • Extend water and sanitary sewer service the required distance to reach the development.


  • Resolve the pipeline crossing conflict without triggering a lift station.


  • Maintain a gravity sewer connection to avoid the added cost and long-term operational burden of pumped infrastructure.


The Solutions JRH Engineering Provided


JRH Engineering worked through the pipeline conflict and successfully negotiated the required clearance from five feet to three feet, allowing the sanitary sewer to maintain a gravity connection and helping the developer avoid the additional cost and long-term operational burden of a lift station.


Result: The development maintained a gravity sewer connection despite the pipeline conflict, avoiding a lift station and its associated construction and long-term operational costs.


This project is a good example of why "utilities available" and "utilities at the site" are two very different things.


Early civil feasibility should verify not only utility capacity, but also the location, depth, extension requirements, easement and pipeline conflicts, and the true cost of getting those utilities to the development.


The lesson: Utility capacity may make a project possible, but the cost of reaching that capacity can materially change the land deal.


Civil Feasibility Can Be a Negotiation Tool


These development challenges don't necessarily make a property a bad deal.


They may simply mean it isn't worth the original asking price.


This is why JRH Engineering encourages developers to perform a civil feasibility study during the due-diligence period and before the land purchase is finalized.


Our civil engineering team can evaluate floodplain impacts, anticipated fill quantities, preliminary detention requirements, utility availability and capacity, pipeline and easement conflicts, drainage and outfall conditions, roadway and access requirements, public infrastructure extensions, impact fees, entitlement considerations, and anticipated permitting challenges.


From there, JRH Engineering can help establish preliminary civil development costs and identify how much of the property may actually remain usable or revenue-producing.


Those findings can then be incorporated into the developer's pro forma and brought back to the negotiating table.


If significant additional infrastructure, fill, detention, or site improvements are necessary just to make the property developable, those costs should be considered when determining what the developer can reasonably pay for the land.


The question shouldn't simply be:


"What does the dirt cost?"


It should be:


"What does this dirt cost once I can actually build on it?"
